Terms of Use
Read the rules and legal terms for using Cakeday

These Terms of Use (“Terms”) govern your access to the Cakeday website, documentation, support communications, and your general use of Cakeday provided by wbx1 Ltd., a company incorporated in the United Kingdom. By using Cakeday, you agree to these Terms.
Eligibility
You must be legally permitted to use Cakeday where you live. If you are under the age required to accept these Terms on your own, a parent or legal guardian must review and accept them for you.
Use Permission
Subject to these Terms and any Apple-provided license terms that apply to the app, wbx1 Ltd. grants you a limited, non-exclusive, non-transferable, revocable permission to access and use Cakeday for your personal and lawful use.
Your Data and Content
Cakeday is designed so that your records remain under your control. As between you and us, you retain rights to the data and files you create, store, export, or share through Cakeday.
You are responsible for the accuracy of information you enter, maintaining any backups you wish to keep, and securing any files you export or share with others.
Acceptable Use
You agree not to:
- use Cakeday in violation of applicable law or others’ rights;
- interfere with, disrupt, or misuse the app, website, or distribution infrastructure;
- reverse engineer, decompile, or disassemble Cakeday except where applicable law clearly permits it;
- use exported or shared data in a way that violates privacy, confidentiality, intellectual property, or other legal rights; or
- misrepresent Cakeday or imply endorsement by wbx1 Ltd. where none exists.
Apple and Third-Party Services
Cakeday is distributed only through the Apple App Store. Your download, installation, and use of the app are also subject to Apple’s platform rules, the applicable Apple Media Services Terms and Conditions, and, unless Apple presents a separate custom end user license agreement for Cakeday, Apple’s Licensed Application End User License Agreement.
If there is any inconsistency between these Terms and mandatory Apple-provided license terms governing the app itself, the Apple-provided license terms control for the app license. These Terms continue to govern the website, documentation, support communications, and other matters not covered by those Apple terms.
Optional features that rely on Apple services, such as iCloud Sync, are subject to Apple’s availability, security, and terms. We are not responsible for third-party services, networks, or distribution platforms we do not control.
Intellectual Property
Cakeday, the website, and all related branding, code, design, text, graphics, and documentation are owned by wbx1 Ltd. or its licensors and are protected by applicable intellectual property laws. These Terms do not transfer ownership of our intellectual property to you.
Availability and Changes
We may update, modify, suspend, or discontinue any part of Cakeday or the website at any time. We are not obligated to maintain any particular feature, compatibility target, or release schedule.
Disclaimer of Warranties
To the maximum extent permitted by law, Cakeday and the website are provided “as is” and “as available.” We disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and security.
Limitation of Liability
To the maximum extent permitted by law, wbx1 Ltd. will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business interruption arising out of or related to your use of, or inability to use, Cakeday or the website.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
Privacy
Your use of Cakeday is also subject to the Privacy Policy and Data Controls.
Termination
You may stop using Cakeday at any time. We may restrict or suspend access to the website or other materials if reasonably necessary to protect the service, comply with law, or address misuse.
Governing Law
Except to the extent mandatory consumer protection law provides otherwise, these Terms and any non-contractual disputes or claims arising out of or in connection with them are governed by the laws of England and Wales.
Subject to any rights you may have under mandatory consumer law, the courts of England and Wales will have exclusive jurisdiction over disputes arising out of or relating to these Terms. If you are a consumer living in another jurisdiction, you may also have rights to bring claims in the courts of your habitual place of residence where applicable law so provides.
Changes to These Terms
We may update these Terms from time to time. The revised version will be posted here with an updated effective date. By continuing to use Cakeday after revised Terms take effect, you agree to the updated Terms.
